US President Donald Trump on Thursday (local time) refiled his $15 billion lawsuit against The New York Times (NYT), a month after a federal judge dismissed the suit for providing “no proper basis” for the court to consider.
District judge Steven Merryday, who dismissed the lawsuit on September 17, had given Trump 28 days to file an amended complaint. The amended suit has been filed in the District Court for Florida’s Middle District in Tampa, and alleges "defamation" of the Republican by the paper, four of its journalists - including two who co-authored a book on him - and a publishing house.
"President Trump is continuing to hold the Fake News responsible through this powerhouse lawsuit against the New York Times, its reporters, and Penguin Random House," a spokesman for his legal team told Fox News Digital.
NYT reiterated its earlier position that the case "has no merit."
"This is merely an attempt to stifle independent reporting and generate PR attention, but we will not be deterred by intimidation tactics," a spokesperson said.
The named defendants are the company (NYT), reporters Susanne Craig, Russ Buettner, Peter Baker and Michael S. Schmidt, and publisher Penguin Random House. Penguin published "Lucky Loser: How Donald Trump Squandered His Father’s Fortune and Created the Illusion of Success," which was written by Craig and Buettner.
Judge Merryday had instructed Trump’s team to shorten its original 85-page complaint to maximum 40 pages. The amended complaint has exactly 40 pages.
The amended lawsuit alleges defamation stemming from The New York Times’ reporting on Trump’s tenure as star of The Apprentice and claims that he engaged in questionable tax maneuvers.
